Independent wrestlers Vik Dalishus and Hale Collins, who have been using the tag team name “The Now” since 2006, are now accusing WWE of infringing on their trademark by using it as a nickname for reigning United States Champion Austin Theory.

Dalishus and Collins have had “The Now” copyrighted since 2006, and many people in WWE are reportedly aware of the duo owning the name.

Dalishus and Collins had sent two cease and desist letters to WWE, but the company has continued to use the nickname on television. According to Dalishus, WWE initially acknowledged their letters and promised to look into the matter. However, Theory and WWE have continued to use ‘The Now’ nickname on weekly television.

Dalishus said, “We have sent two Cease and Desist letters to WWE and Austin Theory continues to be referred to as ‘The Now’ by Corey Graves on commentary, as well as our logo displayed on The Theory Characters ring worn gear & creating confusion in the marketplace. It’s pretty simple.”

“My initial reaction was shock, because of the fact that we have had it copyrighted since 2006, and there’s many people in WWE who know Hale and I, know our names, and know we own it…Our next step is a lawsuit for trademark infringement and creating confusion in the marketplace.”
