Luchasaurus’ Legal Team Pleads For Dismissal Of Amended Complaint In Mask Lawsuit

Composite Effects LLC recently filed a lawsuit against AEW and Luchasaurus for a mask the luchador used on live television. The plaintiff claimed they originally created the mask and AEW had been merchandising it without their permission.

After AEW filed to get five out of the six counts dismissed on March 21, Composite Effects LLC filed an amended complaint alleging Luchasaurus had hired someone to make a similar mask. According to the plaintiff, the resemblance of the altered mask still infringes on their copyright and is a breach of contract. It was later reported on March 24 that Judge Fallon had approved the filing into the record.

On April 7, the legal team for Luchasaurus filed a motion pleading for the dismissal of the amended complaint because of a failure to state a claim.

The defendant stated that Composite Effects LLC didn’t “plausibly allege” that the altered mask isn’t “substantially similar” to the “Viper Silicone Mask” that the plaintiff originally made. Luchasaurus’ side also submitted photos to prove that the modified mask and the original mask are not “substantially similar.” They wrote:

“It is evident from these pictures that the Luchasaurus Mask differs from the Copyright Work in much more than simply the addition of horns. Most obviously, the Luchasaurus Mask is an entirely different shape, covering only the front part of the face above the mouth, rather than covering the full head with a cowl extending to the shoulders.”

In other news, AAA TripleMania XXXI will take place on April 16, July 15, and August 12, 2023. The April 16 event will take place at Estadio de Béisbol Monterrey in Monterrey, the July 15 event will take place at Estadio Chevron in Tijuana, and the August 12 event at Arena Ciudad de México in Mexico City.

AAA has announced that TripleMania XXXI will stream on FITE this Sunday. The pay-per-view will be available for $22.99, or can be purchased as a bundle for $59.99. The bundle includes the TripleMania events in Tijuana (July 15) and Mexico City (August 12).
